By accessing or using Lernex, you agree to be bound by these Terms & Conditions. If you disagree with any part of them, please do not use the Service.

• —You must be at least 13 years old, or older where your country's laws require it, to use Lernex
• —You agree not to misuse Lernex, including attempting to hack, disrupt, scrape, resell, or cheat the system
• —You are responsible for maintaining the confidentiality of your account credentials
• —You must not use the Service for any illegal or unauthorized purpose

When creating an account, you agree to provide accurate and complete information. We reserve the right to suspend or terminate accounts that violate these Terms. You are responsible for all activities that occur under your account.

Lessons, quizzes, flashcards, explanations, narrated videos, and recommendations on Lernex are produced by AI models — both models operated by Lernex and models operated by third-party providers. That has consequences you should read before you rely on anything the Service tells you:

• —AI output can be incomplete, outdated, or wrong. Lernex is a study aid. It does not replace your instructor, your course materials, or your own judgment
• —Do not rely on Lernex output for medical, legal, financial, safety, or other consequential decisions
• —You are responsible for how you use what you generate, including any academic-integrity rules your school or program applies to you
• —Material you submit (prompts, notes, documents, images, and audio) may be sent to AI providers for processing, as described in the Privacy Policy
• —Two people asking the same question will not receive identical output, and the same question asked twice will not repeat. Generated content is not guaranteed to be reproducible

• —Lernex itself, including the software, design, branding, and the systems that generate content, is owned by Lernex and protected by copyright and trademark laws
• —You may use Lernex only for personal, non-commercial learning purposes
• —You retain ownership of any content you submit but grant Lernex a worldwide, royalty-free license to use it within the Service
• —As between you and Lernex, content generated for you is yours to use for your own learning. You may not resell it, redistribute it as a product, or use it to train a competing model
• —You must not reproduce, distribute, or create derivative works from Lernex's own content without permission

Lernex offers a free plan and paid plans. Each plan includes an allowance of AI creation that refreshes on the cadence shown on the pricing page.

• —Paid plans are billed in advance at the price disclosed at checkout, and renew automatically each period until cancelled
• —You may cancel at any time from your account settings. You keep access through the end of the period you have already paid for
• —Upgrades take effect immediately and are prorated; downgrades take effect at your next billing date
• —We may change pricing with reasonable advance notice to existing subscribers. A change applies from your next renewal, never retroactively
• —Payments made on the web are processed by Stripe. We do not see or store your card details. Taxes may apply based on your region

Sparks are a prepaid balance that lets you keep creating after a plan’s allowance is spent. They are a limited license to use features of the Service — not currency, not property, and not a stored-value or money-transmission instrument.

• —Sparks have no cash value and cannot be redeemed, exchanged, sold, or transferred to another person or account
• —Sparks do not expire while your account is open and in good standing
• —Sparks are consumed as you use them. Bonus Sparks granted with a volume purchase, a promotion, or an award are not separately refundable
• —Unused Sparks are forfeited if you delete your account, or if we terminate it for a breach of these Terms
• —The number of Sparks a given action costs may change as model and infrastructure costs change. Any change applies to future use only, never to Sparks you have already spent

This is the whole policy, in the same words the pricing page uses: there’s a 14-day money-back guarantee on paid plans. If the progress isn’t there in your first two weeks, reach out and we’ll refund you in full.

• —To claim it, email support@lernex.net within 14 days of your first charge on a paid plan. No form, no phone call
• —The guarantee covers the first charge on a paid plan, once per account. Later renewals are not automatically refundable, though you can cancel at any time and keep access until the period ends
• —Sparks are consumed as you use them and are not covered by the plan guarantee. If you bought Sparks by mistake and have not used them, contact us within 14 days and we will make it right
• —Purchases made through Apple or Google are refunded by that store under its own policy; see the next section. We will help you get there
• —None of the above limits any refund or withdrawal right you have under the law where you live

The Lernex apps for iOS and Android are licensed to you, not sold. You get a personal, non-transferable license to use them on devices you own or control, subject to the applicable app store’s own terms of service.

• —Subscriptions and Sparks purchased inside the apps are processed by Apple or Google, not by Lernex. Billing, renewal, and cancellation are managed in your App Store or Google Play account settings
• —In-app subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Deleting the app does not cancel a subscription
• —Refunds for in-app purchases are handled by Apple or Google under their own policies. We cannot issue them directly, but we will help you file the request
• —These Terms are between you and Lernex only. Apple and Google are not parties to them and have no responsibility to provide maintenance or support for the apps
• —Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to the iOS app

The Service is provided “as is” without warranties of any kind, either express or implied. We do not guarantee:

• —Uninterrupted or error-free access to the Service
• —That the Service will meet all your requirements
• —The accuracy or reliability of any content, including AI-generated content
• —Specific learning outcomes, grades, or results

To the maximum extent permitted by law, Lernex and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses arising from your use of the Service.

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or engage in conduct that we determine is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease, and any unused Sparks are forfeited as described in section 7.

We reserve the right to modify or update these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of Lernex after changes become effective constitutes acceptance of the updated Terms.

These Terms shall be governed and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the appropriate courts.
